By accessing this website, submitting an enquiry, or requesting a quotation, you agree to use the website lawfully and not to interfere with its security, operation, content, or other users. Website content is provided for general commercial information and does not itself constitute a binding offer.

Quotations and contract formation

A binding order is created only when Atlas Hospitality Supply accepts the customer’s official purchase order or written order confirmation and the required payment or deposit has been received, unless otherwise agreed in writing. Quotations are subject to validity periods, specifications, quantities, availability, manufacturing capacity, exchange rates, freight, duties, taxes, and other terms stated in the quotation.

Specifications, samples, and approvals

Customers are responsible for reviewing all product descriptions, dimensions, quantities, materials, colours, branding, artwork, samples, mock-ups, lab dips, embroidery details, packaging, delivery details, and commercial terms before approval. Production based on approved specifications, samples, or artwork is considered authorised by the customer.

Prices, taxes, and payment

Prices may be stated as EXW, freight-inclusive, delivered, or on another agreed commercial basis. Freight, customs duty, clearance, port charges, taxes, local delivery, unloading, installation, and other costs are included only when expressly stated. Payment terms, currency, bank details, deposit requirements, and release conditions are stated in the applicable quotation or order confirmation.

Production and delivery

Production and delivery dates are estimates unless expressly guaranteed in writing. Timelines may be affected by sample approval, production capacity, raw materials, shipping schedules, customs, port operations, weather, force majeure, customer delays, or other circumstances outside reasonable control. Partial deliveries may be arranged where commercially appropriate.

Ownership and risk

Risk and title transfer according to the commercial basis and delivery terms stated in the applicable quotation, invoice, or written agreement. Atlas may retain ownership of goods until full payment has been received where legally permitted and expressly stated in the commercial documents.

Intellectual property

Website text, layout, graphics, branding, catalogues, quotations, specifications, and original materials are owned by or licensed to Atlas Hospitality Supply and may not be reproduced, republished, or used commercially without written permission. Customer logos and artwork remain the customer’s property, and the customer confirms that it has authority to authorise their use for the order.

Liability

To the maximum extent permitted by applicable law, Atlas is not liable for indirect, incidental, special, or consequential losses, including loss of profit, revenue, goodwill, bookings, or business opportunity. Any liability relating to supplied goods is subject to the accepted commercial documents, applicable warranty, verified defect, proper use and care, and applicable law.

Governing law and disputes

These website terms and transactions with Atlas are governed by the applicable laws of the United Republic of Tanzania and, where relevant, Zanzibar. The parties should first attempt to resolve disputes through good-faith commercial discussions before pursuing any formal remedy available under the applicable agreement or law.
